Rules for assigning an identifier (token) and applying the "Advertisement" marking on ad creatives
In fulfillment of the requirements of Federal Law No. 38-FZ "On advertising" dated March 13, 2006, the parties have agreed on the following:
1. The publisher undertakes to use ad creatives in the form they were provided to them or were hosted in the Admitad system.
2. If the publisher designs ad creatives on their own, based on the source materials provided to them or hosted in the Admitad system, for further placement, the publisher undertakes to assign an identifier (token) and apply the "Advertisement" marking on such ad creatives, ensuring full compliance with Federal Law No. 38-FZ "On advertising" dated March 13, 2006, and other regulations, by concluding the relevant agreement with the advertising data operator.
3. The publisher is responsible for assigning an identifier (token) and applying the "Advertising" marking, and is responsible, as an advertiser, for the content and credibility of ad creatives they designed. The publisher also guarantees that the content of such ad creatives does not violate the current legislation of the Russian Federation, including the exclusive intellectual property rights and rights to the equivalent means of individualization.
4. If the publisher violates the requirements regarding placement of ad creatives, including the requirements stipulated in the affiliate program, the publisher shall pay the fine that equals to the total of all rewards accrued or paid for the period of placement of such ad creatives made with violation of the requirements of the affiliate program and Federal Law No. 38-FZ "On advertising" dated March 13, 2006. The publisher shall also compensate Admitad for losses including, but not limited to, the requirements of the Advertisers/Clients, administrative fines imposed by Russian authorities.
